These Terms and Conditions ("Terms") govern your access to and use of www.mydriverly.com, Driverly courses, certificates, educational materials, and related services. By accessing, purchasing, enrolling in, or using a Driverly service, you agree to these Terms. If you do not agree, do not use the Website or Driverly services.
1. User Responsibility
You remain solely responsible for your driving behavior, vehicle operation, compliance with applicable laws, licensing requirements, traffic regulations, employer policies, and safety requirements. Completion of a Driverly course does not relieve you of any legal duty or obligation. You must exercise independent judgment and comply with applicable laws and regulations.
2. Educational Purpose Only
Driverly provides educational content about defensive driving, safe-driving practices, transportation safety, and related subjects. Driverly is an educational content provider only. Enrollment does not create a driving instructor-student, legal advisory, professional advisory, vocational training, certification, or other professional relationship.
Driverly does not provide behind-the-wheel instruction, legal advice, regulatory-compliance services, employment qualification, or government-approved education unless Driverly expressly states otherwise in writing.
3. No Accreditation, Approval, or Guaranteed Outcome
Unless Driverly expressly states otherwise in writing, Driverly courses are not accredited or approved by a court, insurance company, department of motor vehicles, licensing authority, government agency, employer, or other third party. You are solely responsible for determining whether a course meets a requirement imposed by any court, insurer, employer, government agency, licensing authority, or other third party.
Driverly does not guarantee court acceptance, insurance discounts, point reduction, license reinstatement, regulatory compliance, employment eligibility, improved driving ability, collision prevention, or any other outcome.
4. Certificates of Completion
Driverly may issue a certificate after a learner satisfies the applicable course-completion requirements. A certificate reflects completion of a Driverly educational course only. It is not professional certification, licensure, accreditation, proof of competency, or a promise that any court, insurer, employer, government agency, or other third party will accept it.
5. Certificate Acceptance Money-Back Guarantee
To request a refund, email support@mydriverly.com and provide:
- a copy of your Driverly certificate of completion;
- the name of the Driverly course and the date you completed it; and
- a signed and certified or otherwise authenticated letter from the rejecting court or insurance company.
The rejection letter must be issued on the court's or insurance company's official letterhead, or otherwise be certified or authenticated by that organization. It must identify you and the rejected Driverly certificate or course, clearly state that the certificate was rejected, explain the reason for the rejection, and be signed by an authorized current court official or insurance-company employee.
The letter must also include the signer's full name, title, organization, direct telephone number, and business email address so Driverly can independently contact the signer to verify the rejection and the letter's authenticity. Driverly may contact the signer and the issuing organization for this purpose.
Driverly will issue the refund after it receives all required documentation and verifies it. A refund request is not approved if Driverly cannot verify the documentation, the signer's authority, or the rejection with the court or insurance company. An approved refund may take up to 60 days to process.
This limited money-back guarantee is the remedy for a verified certificate rejection. It does not represent or guarantee that any court, insurer, employer, government agency, or other third party will accept a Driverly certificate, provide a discount, dismiss a citation, reduce points, or produce any other result.
6. Assumption of Risk
Driving involves substantial risks, including property damage, vehicle damage, serious bodily injury, permanent disability, and death. You acknowledge those risks and voluntarily assume risks associated with operating a vehicle. Driverly does not control how you apply course information.
7. Disclaimer of Warranties
To the maximum extent permitted by law, the Website, courses, certificates, materials, and services are provided "as is" and "as available." Driverly disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, reliability, availability, and security.
8. Limitation of Liability
To the maximum extent permitted by law, Driverly and its owners, officers, directors, employees, contractors, instructors, affiliates, agents, successors, and assigns are not liable for personal injury, death, property or vehicle damage, financial loss, lost profits, insurance consequences, traffic citations, court consequences, or indirect, incidental, consequential, special, or punitive damages arising from use of the Website or services. If liability cannot be fully excluded, Driverly's total liability will not exceed the amount you paid for the applicable course.
9. Course Content and Intellectual Property
Driverly strives to provide useful educational information, but laws, regulations, safety standards, and industry practices can change. You are responsible for independently verifying current legal, regulatory, licensing, and safety requirements applicable to you.
All Website content, including text, graphics, videos, course materials, assessments, certificates, logos, designs, and branding, is owned by Driverly or its licensors and protected by applicable intellectual-property laws. You may not copy, reproduce, distribute, modify, sell, or exploit it without prior written permission.
10. Indemnification, Termination, and General Terms
You agree to defend, indemnify, and hold harmless Driverly and its owners, employees, affiliates, contractors, instructors, successors, and assigns from claims, damages, liabilities, losses, costs, expenses, or attorneys' fees arising from your use of the Website, course participation, vehicle operation, violation of law, violation of these Terms, or reliance on course materials.
Driverly may suspend, restrict, or terminate access at any time. These Terms are governed by the law of the jurisdiction in which Driverly operates, without regard to conflict-of-law principles. If any provision is unenforceable, the remaining provisions remain in effect. These Terms are the entire agreement concerning use of the Website and services.
